Courts have guidelines for judging the methodologies of experts. Under the bright-line <\/span><i><span style=\"font-weight: 400;\">Frye<\/span><\/i><span style=\"font-weight: 400;\"> standard, for instance, the methodologies must be generally accepted by a scientific community. Under the more flexible <\/span><i><span style=\"font-weight: 400;\">Dauber<\/span><\/i><span style=\"font-weight: 400;\">t standard, the judge determines the acceptability of the methodologies used. <\/span>[\/vc_column_text][\/vc_column_inner][\/vc_row_inner][vc_row_inner el_id=&#8221;two&#8221;][vc_column_inner el_id=&#8221;two&#8221;][vc_column_text css=&#8221;&#8221;]<\/p>\n<h2><strong>Prevalence of Women as Expert Witnesses<\/strong><\/h2>\n<p><a href=\"https:\/\/www.expertwitness.co.uk\/articles\/journal\/women-appointed-or-testified-as-sole-expert-witnesses-in-just-10-of-disputes-worldwide-in-2022-new-survey-from-ere-reveals\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">As of 2022, female experts were appointed as the sole expert in just 10% of all expert witness cases<\/span><\/a><span style=\"font-weight: 400;\">, with an additional 26 percent seen in court along with a male expert. That is, 64 percent of cases did not use females as expert witnesses. Moreover, according to a figure widely <\/span><a href=\"https:\/\/news.bloombergtax.com\/us-law-week\/gender-gap-for-female-experts-wont-be-easily-narrowed-1?context=search&amp;index=8\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">attributed<\/span><\/a><span style=\"font-weight: 400;\"> to The Expert Institute,\u00a0 80% of expert witnesses chosen by attorneys are male.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">There are several possible reasons for the scarcity of expert female witnesses. First, attorneys may be more likely to retain male expert witnesses than female ones due to their belief,\u00a0 based on an unconscious bias, that a female may be less credible in court. Empirical research is mixed on this point, with<\/span><a href=\"https:\/\/purdueglobal.dspacedirect.org\/server\/api\/core\/bitstreams\/1339e52c-68b4-4a1b-9dd7-cf328f001a81\/content\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\"> some studies<\/span><\/a><span style=\"font-weight: 400;\"> (e.g., Flick and Schweitzer, 2022)\u00a0 showing a bias toward men and at least <\/span><a href=\"https:\/\/www.sciencedirect.com\/science\/article\/pii\/S0167268125000320\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">one study<\/span><\/a><span style=\"font-weight: 400;\"> (Sievertsen and Smith, 2025) showing a bias<\/span><i><span style=\"font-weight: 400;\"> toward<\/span><\/i><span style=\"font-weight: 400;\"> women.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Biases aside,\u00a0 men have outnumbered women in this field for several other reasons. First, fewer women have achieved credentials in the STEM fields (science, technology, <\/span><a href=\"https:\/\/www.fictiv.com\/articles\/women-in-engineering-statistics-32-notable-facts\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">engineering, <\/span><\/a><span style=\"font-weight: 400;\">and mathematics) \u2014 a typical criterion for the role of an expert in <\/span><a href=\"https:\/\/www.acc.com\/sites\/default\/files\/2022-10\/ACC_State_Corp_Litigaton_Report.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">highly litigated industries<\/span><\/a><span style=\"font-weight: 400;\"> such as construction and biotech. Second, attorneys often engage experts they have previously worked with. This triggers a preference for males in networks and reduces opportunities for women. And even if women have credentials similar to their male counterparts, jurors and attorneys view them as less credible in disciplines that are stereotypically associated with men.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">These odds discourage women from joining the thriving expert witness industry despite their competence and skills. But the percentage of female expert witnesses has begun to increase in recent years, with many women taking an interest in the field. Individuals and organizations have also established initiatives to support this shift. <\/span><a href=\"https:\/\/www.expertwitnesspledge.com\/take-the-pledge\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">The Equal Representation for Expert Witnesses pledge<\/span><\/a><span style=\"font-weight: 400;\">, for instance, was launched to encourage more women to come forward, promote their appointment by parties, and support their professional development through mentoring.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As a result, women are starting to make their marks as expert witnesses. While they have long been <\/span><a href=\"https:\/\/ilostat.ilo.org\/blog\/where-women-work-female-dominated-occupations-and-sectors\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">more prevalent<\/span><\/a><span style=\"font-weight: 400;\"> in fields such as education, healthcare, and psychology,\u00a0 in recent years they have begun to dominate <\/span><a href=\"https:\/\/www.careerexplorer.com\/careers\/forensic-psychologist\/demographics\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">forensic psychology<\/span><\/a><span style=\"font-weight: 400;\">, putting them in a strong position to provide expert testimony in this in-demand arena. \u00a0 <\/span><\/p>\n<p><span style=\"font-weight: 400;\">In the courtroom, <\/span><a href=\"https:\/\/www.psychologytoday.com\/us\/blog\/creating-wellbeing-wherever-you-are\/202507\/3-ways-female-stress-responses-differ-from-males\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">responses to stress<\/span><\/a><span style=\"font-weight: 400;\"> can vary by gender\u2014meaning that women may experience testimony differently from men. Hence, men and women may navigate the legal system and their role as expert witnesses differently.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Attorneys strategically choose expert witnesses with due regard to the context of their case and the jurors&#8217; perception of a certain gender. For example, in cases involving sexual harassment and assault, defense attorneys may be more inclined to retain female expert witnesses than male ones. Jurors may perceive female experts to be more empathetic, sensitive, and approachable. Nonetheless, it is a very common requirement.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Demeanor of the Expert During Deposition and Cross-Examination<\/b><span style=\"font-weight: 400;\">: An expert is expected to have the ability to explain complex concepts in simple terms. They must speak with confidence and composure during deposition and cross-examination. A nervous or defensive demeanor may negatively affect the perception of the expert\u2019s credibility.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Accuracy of Testimony<\/b><span style=\"font-weight: 400;\">: In any legal proceeding, all individuals who testify are obligated to tell the truth. An expert\u2019s testimony, in particular, must be accurate, rational, and consistent. It must not contradict itself and should be aligned with the evidence presented in court. In a <\/span><a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/24691753\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">survey<\/span><\/a><span style=\"font-weight: 400;\"> conducted with 352 mock jurors, male experts were rated as more credible than women, even when their answers matched. <\/span><span style=\"font-weight: 400;\">Furthermore, research reveals that style and nonverbal cues such as female expert witnesses\u2019 attire, cosmetics, and posture are also assessment metrics for jurors. A<\/span> <a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/37016533\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">study<\/span><\/a> <span style=\"font-weight: 400;\">published in the Journal of Forensic Science in 2023 found that women in skirt suits with closed postures were perceived as more credible than those in pantsuits and open postures. Attorneys and judges must be made aware of gender stereotypes and unconscious biases through regular gender sensitization workshops and programs. Further, jurors must be carefully instructed to be mindful of such biases and counteract them during their deliberations.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">By fostering inclusion and providing targeted support, more women will be motivated to participate as expert witnesses and in other high-impact legal roles.
